Sales Contract

At Newsomes Royal K9S And Kittens, we take great pride in providing healthy, happy, and well-socialized puppies to loving homes. To ensure the welfare of each puppy and provide our customers with the highest standard of service, we have outlined the terms and conditions of our Pet Sales Contract. This contract is a formal agreement between the Buyer and the Seller, detailing the responsibilities of both parties involved in the purchase of a puppy.

Terms of Sale

Pet Information

The Seller agrees to sell a [Male/Female] puppy, born on [Birth Date], to the Buyer for the amount of $[Price], which has been received by the Seller.

Health Guarantee

The Seller guarantees that the puppy is in good health on the date of delivery. To maintain this guarantee, the puppy must be examined by a licensed veterinarian within 72 hours of purchase. This health guarantee is only valid if the puppy is checked by a licensed vet within this time frame. Buyer must vaccinate puppy(s) with the appropriate vaccines at the appropriate time and age of the puppy. Buyer needs to contact their veterinarian for vaccine schedules. Please note that the Seller will not cover any veterinary costs. Seller will not be responsible for any illness contracted after the puppy(s) leaves her care. There is No Guarantee against Parvo. Your puppy(s) has been vaccinated against Parvo @ age 7 weeks with a 5 way shot. The buyer has been given the health record of vaccine and deworming and has seen the vet care check. Once puppy(s) leaves the Seller’s care it is out of Seller’s control. Seller suggest Buyer get pet insurance before bringing your puppy(s) home. When getting a new pet it is always best to be safe rather than sorry. Puppies immune systems are still weak.

Common Pet Issues

The Seller does not warrant the puppy to be free from common puppy issues such as diarrhea (due to diet or environmental changes), parasites (internal or external), kennel cough, coccidia, giardia, hypoglycemia, and other similar concerns. The Buyer is responsible for maintaining a healthy environment for the puppy, including ensuring proper nutrition, vaccinations, flea prevention, and heartworm protection.

Congenital Defects

The Seller guarantees the puppy against congenital life-threatening defects for 6 months from the date of purchase. If the puppy is found to have a non-treatable, life-threatening condition, a detailed veterinary report must be submitted to the Seller within 48 hours for verification. The Seller will then offer a replacement puppy when one is available, but no refunds will be provided under any circumstances.

Replacement Pet

In the case of a life-threatening congenital defect, the Seller will provide a replacement puppy, but only after the required documentation is submitted. The Buyer will be responsible for all transportation costs associated with obtaining the replacement puppy. No refunds will be issued, and the credit cannot exceed the original purchase price.

Exclusions from Guarantee

The Seller’s guarantee does not cover conditions such as Demodex, thyroid disorders, hernias, cherry eye, entropion, undescended testicles, uneven bites, retained teeth, potty training ability, hernias of any kind, loose hips, allergies, or minor illnesses. The Seller does not guarantee the puppy’s adult size, weight, color, conformation, temperament, or breeding ability. The puppy(s) are Sold As Pet Quality Only. If the puppy(s) is resold/given away to another party other then who the seller sold the puppy to or at a different residence from where my records indicate the puppy was to go to this health guarantee is void immediately.

Neglect or Abuse

If the puppy is found to be neglected or abused, the terms of this contract will become void, and no further action will be taken by the Seller. The Buyer is required to provide proper care and attention to the puppy at all times.

Euthanasia and Pet Return

If a puppy is euthanized due to a life-threatening congenital defect, the Buyer must first obtain permission from the Seller before proceeding. Unauthorized euthanasia will void the guarantee, and no replacement puppy will be provided.

Final Acknowledgment

By purchasing said puppy(s) the buyer gives the seller full permission to use any photos or videos shared to seller for all of sellers social medias. By accepting delivery of the puppy, the Buyer acknowledges that they have read, understood, and agreed to all terms and conditions of this contract. The Buyer agrees to fulfill all responsibilities related to the care and well-being of the puppy.

No Breeding Policy:

By purchasing a pet from Newsomes Royal K9S And Kittens, you agree to strictly refrain from breeding any of our animals. If you are found to be breeding any of our pets, you will be required to pay the following fees:

  • $10,000 for breeding
  • $3,000 for each puppy or kitten produced
  • Regardless of the conditions and the circumstances surrounding the negotiation of this Sales Agreement Buyer and Seller agree that the interpretation and enforcement of this agreement shall be governed by the laws of the State of MISSOURI, and any legal action instituted by Buyer or Seller to enforce any term, condition, or clause of this agreement shall be filed in the appropriate Court in the County of OSAGE in the state of MISSOURI.

     

Newsomes Royal K9S And Kittens will take legal action against individuals who make defamatory statements about our business.
